These terms apply when you browse our website or apply to work with NXT Wave as a creator or chatter. Client and contractor engagements are covered by separate written agreements.

1. Agreement to these terms

These Terms of Service ("Terms") govern your use of the NXT Wave website, including our creator and chatter application forms. The website is operated by NXT Wave LLC ("NXT Wave", "we", "us").

By using the website, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the website.

2. Eligibility

You must be at least 18 years old, and the age of majority where you live, to use this website or submit an application. By using the website, you confirm that you meet this requirement. We verify the age and identity of every creator and chatter before any engagement begins.

3. What this website is

This website describes NXT Wave's marketing, automation, and chat management services and lets you apply to work with us. Nothing on the website is an offer to enter a contract.

Any engagement with NXT Wave, whether as a creator client or as a chatter, is governed by a separate written agreement. If that agreement conflicts with these Terms, the agreement prevails.

4. Applications

  • The information you submit must be accurate, complete, and about you. Don't apply on someone else's behalf.
  • We never charge a fee to apply or to be considered.
  • We review applications at our discretion and may decline any application without giving a reason.
  • Submitting an application doesn't create an employment, contractor, agency, or partnership relationship, and acceptance isn't guaranteed.

5. No earnings guarantees

Client results shown on this website come from anonymized accounts and illustrate what's possible, not what's typical or guaranteed. Revenue, follower growth, and ARPU depend on many factors outside our control, including your niche, content, consistency, audience, and the policies of third-party platforms.

6. Third-party platforms and tools

Our services involve platforms and tools owned by third parties, including OnlyFans, Meta (Instagram, Threads, and Facebook), X, YouTube, Telegram, Snapchat, CupidBot, and CapitalAI. NXT Wave is independent and is not affiliated with, endorsed by, or sponsored by any of them. Their names and trademarks belong to their respective owners.

Your use of those platforms is governed by their own terms. We aren't responsible for their availability, content, or policy changes, or for the content of websites we link to.

7. Acceptable use

When using the website, you agree not to:

  • Submit false or misleading information, or impersonate anyone.
  • Submit information about anyone under 18, or any explicit content.
  • Send spam, malware, or automated submissions.
  • Scrape, probe, overload, or try to gain unauthorized access to the website or its systems.
  • Use the website for any unlawful purpose.

We may block access or delete submissions that break these rules.

8. Intellectual property

The website and its content, including text, design, graphics, and the NXT Wave name and logo, are owned by or licensed to NXT Wave LLC and are protected by intellectual property laws. We treat the information in your application as confidential and handle it as described in our Privacy Policy. Don't include confidential information that belongs to anyone else. By submitting, you confirm you have the right to share everything you send us.

To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 11. Limitation of liability

To the fullest extent permitted by law, NXT Wave and its owners, staff, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the website.

Our total liability for any claim arising from your use of the website is limited to USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold NXT Wave harmless from any claims, losses, and expenses, including reasonable legal fees, arising from your breach of these Terms or from information you submit.

13. Governing law and disputes

These Terms are governed by the laws of Philippines, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the website will be resolved in the courts of that jurisdiction. If you're a consumer, you keep any protections that the mandatory laws of your country of residence give you.

14. Changes to these terms

We may update these Terms from time to time and will revise the "Last updated" date at the top of this page. Continuing to use the website after an update means you accept the revised Terms.

If any part of these Terms is found unenforceable, the rest remains in effect.
